Good Estate Planning Requires an Attorney

April 24, 2013 by Stephen A. Mendel, Estate Planning Attorney

You might think you know what you need in your estate plan. You may have even read some information online from some company that wants to sell you forms that they claim are all you need. Before you buy those forms, you should consider a few things first.

The law in every state is different. Online companies know that, but their forms barely scratch the surface of accounting for the differences. A form that might be perfect for New York. might be completely invalid in Texas. However, online you will get the same form for both states. The only difference is that the New York form will say “New York” and the Texas form will say “Texas.”

Another consideration is whether you really know what you need after reading what a salesperson writes online. Sure, that instrument might sound great, but what if there are better options? What if a Family Limited Partnership would work better for what you want to do than a Revocable Living Trust? The company selling the Trust form, won’t tell you that.

If you want to create an estate plan, that’s a great decision. Instead of trusting your estate to an online company, talk to an estate planning attorney in your area.
